Our store is hosted on Squarespace. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Grégoire Pansu Photography be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Grégoire Pansu Photography and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. ONLINE PAYMENTS

I accept Visa, Mastercard and American Express, as well as bank transfers (for some services / workshops). I process payments via Squarespace/Paypal/Stripe, which are compliant with the PCI DSS security standard.

I neither store nor process your sensitive data, all interaction is done by receiving a reply from Paypal/Stripe, which contains the result of the transaction.

Payments are done in the local company’s currency – EUR.

PHOTOGRAPHY CLASSES AND WORKSHOPS

DISCLAIMER

The workshops and classes are dependent on weather conditions.

CANCELLATION AND REFUND POLICY

Workshops : to secure your booking, a non-refundable deposit is necessary. This deposit is a percentage of the total price of the workshop. The exact percentage is calculated based on the total workshop cost, which may vary. This percentage represents the expenses related to the various services we must secure, all of whom require non-refundable deposits. Some workshops may require a higher initial deposit due to location-specific needs. Information about the specific deposit amounts can be found on the individual workshop page on our website and will be sent to you once we’ve received your registration form.

Full payment must be completed no later than 90 days before departure. If we do not receive your final payment by this date, we will notify you via email to request the final payment. Full payment needs to be made in order to confirm your booking. Failure to make this payment will result in the cancellation of your booking, and your spot will be offered to participants on the waiting list.

If you complete your registration for a workshop less than 90 days before the beginning of said workshop, the full payment is required. Failure to pay on time may result in the cancellation of your booking. If you wish to cancel your participation, please send us an email. Your cancellation is not considered to be valid until you receive a confirmation email from us acknowledging your cancellation.

Upon receiving your cancellation notification, we will charge the following fees per person.

In the event that you need to cancel your participation in the workshop, and your spot is filled by another participant, you will receive a refund of the total amount paid minus a 250 EUR service fee. However, if you cancel and your spot remains unfilled, your refund will be based on the following schedule :

  • Cancellation 180 days or more before the beginning of the workshop : 20% of the total workshop cost is forfeited, along with a 250 EUR service fee.

  • Cancellation between 90 and 180 days before the beginning of the workshop : 50% of the total workshop cost is forfeited, along with a 250 EUR service fee.

  • Cancellation between 60 and 90 days before the beginning of the workshop : 75% of the total workshop cost is forfeited, along with a 250 EUR service fee.

  • Cancellation 60 days or less before the beginning of the workshop or after the workshop has started : 100% of the workshop cost is forfeited. No refund will be provided.

Refunds will be done using the same method used when the original payment was made.

Classes : Full payment must be completed when booking. If we do not receive your final payment, we will notify you via email to request the payment. Full payment needs to be made in order to confirm your booking. Failure to make this payment will result in the cancellation of your booking, and your spot will be offered to participants on the waiting list.

If you wish to cancel your participation, please send us an email. Your cancellation is not considered to be valid until you receive a confirmation email from us acknowledging your cancellation. If you cancel, then you will be refunded according to the following schedule, based on the full price of the class :

  • Cancellation 7 days or more before the date of the class : full refund, minus payment processing fees.

  • Cancellation between 5 and 7 days before the date of the class : 75% refund, minus payment processing fees.

  • Cancellation between 3 and 5 days before the date of the class : 50% refund, minus payment processing fees.

  • Cancellation less than 3 days before the date of the class : no refund.

Refunds will be done using the same method used when the original payment was made.

ACKNOWLEDGEMENT OF ACTIVITY RISKS AND TRAVEL INSURANCE RECOMMENDATION

I want to acknowledge the inherent risks that come with the activities I'm about to partake in, organized by the team and their associated entities (referred to as "the Workshop Guides"). Despite the considerable efforts made by the Workshop Guides to ensure my safety by providing appropriate equipment and experienced guides, I understand that these activities carry inherent risks. These risks can result in equipment damage, accidental injuries, illnesses, and, in rare instances, severe trauma or loss of life. The Workshop Guides aim to offer a rewarding experience while also responsibly disclosing these inherent risks to me. Some of these risks encompass weather-related events such as storms, lightning, and strong winds, exposure to extreme temperatures, injuries related to challenging terrains, falls from heights, accidents in the water, physical exertion-related ailments, and equipment damage.

I am well aware of the potential hazards associated with these activities, and I recognize that the list of inherent risks provided above is not exhaustive. There may be additional, unforeseen risks that could lead to injury or loss of life. I willingly accept full responsibility for the risks identified herein, as well as those risks that have not been explicitly mentioned. My participation in these activities is entirely voluntary, and no one has coerced me into joining. I have chosen to participate with full awareness of the inherent risks.

I acknowledge that these activities may demand a specific skill set and knowledge that sets them apart from other recreational pursuits. The Workshop Guides have offered comprehensive explanations regarding the nature of these activities, their physical demands, and the potential risks, hazards, and dangers involved. I confirm my capability to participate fully in these activities and acknowledge my accountability for any bodily harm, loss of personal property, and expenses incurred due to the identified and unidentified inherent risks, or due to my own negligence during my participation.

Furthermore, I strongly recommend considering the acquisition of travel insurance that encompasses the total value of the Trip and personal belongings, should you experience trip cancellations, baggage loss or theft, or require emergency evacuation. It is essential to understand that in the event of trip delays, cancellations, or early terminations for any reason, you may forfeit a portion or the entirety of the fees paid.

Travel insurance is a prudent means to mitigate the financial risks associated with delayed departures due to weather, airline strikes, missed connections, inability to travel due to illness, injury, unforeseen financial challenges, personal circumstances, or early trip termination for medical or other reasons.

It is advisable to thoroughly review the details of your insurance policy, as there may be certain restrictions and limitations in place.

Workshop Guides shall not assume any liability for potential accidents that may occur to customers during the workshops. Customers book workshops at their own discretion and shall be solely responsible for any accident. We therefore strongly advise customers to take out an appropriate insurance plan covering potential accidents.

It is important to note that Workshop Guides do not function as mountain or alpine guides; they exclusively serve as instructors for landscape photography. The workshops are conducted at the designated and advertised location, and it is the customers' sole responsibility to independently reach the workshop location, assuming all associated risks. Workshop Guides shall not be held accountable for any potential accidents that may occur during the journey to access the workshop location, be it on a hiking trail or road.

ITINERARY CHANGES

I reserve the right to change the workshop/class dates, itinerary, or accommodations. I reserve the right to change the itinerary due to weather conditions, political conditions and other factors beyond our control without consulting the participants. It is understood that such decisions will be made in the best interests of all participants and with regards to safety first. Participants have no right to any refund or other considerations in the event of these inevitable itinerary changes. If a trip must be delayed, or the itinerary changed due to bad weather, road conditions, transportation delays, government intervention, sickness, volcanic eruptions or other contingency, the cost of delays or changes is not included.

WORKSHOP CANCELLATION

I reserve the right to cancel workshops/classes before departure for any reason whatsoever, including too few participants or logistical problems, or any other circumstances which may make the trip inadvisable. All trip payments received will be refunded, and this refund will be the limit of my liability. I am not responsible for any expenses incurred by trip members in preparing for the trip, such as nonrefundable or penalty-carrying airline tickets, visa or passport fees or other trip related expenses.

LIMITATIONS OF LIABILITY

I assume no responsibility whatsoever for injuries, loss or damage to person or property in connection with any service resulting directly from: detention, annoyance, delays, expenses arising from quarantine, strikes, thefts, pilferage, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, terrorism, government restrictions or regulations and discrepancies or changes in transit or hotel services over which I have no control. In case of a medical problem arising during the expedition, which results in costs for evacuation, use of an aircraft or repatriation, the responsibility for the payment of these costs belongs solely to the participant of the class/workshop. I advise that participants ensure that such eventualities are covered by their travel insurance. If the costs are not covered by their travel insurance, then the responsibility still belongs to the passenger and I specifically decline any responsibility whatsoever.

RETURNS

The packaging is very tough, but in the rare event that your print arrives damaged in any way, I will gladly replace it for you, completely free of charge. Just send me an email containing pictures of the package and of the damaged print, as well as the order number, at gregoirepansu@gmail.com. I will arrange a replacement right away. I’ll also cover the return shipping cost. I do not offer exchanges, returns or reimbursements if you are unhappy with the products you have ordered.

CUSTOMS

Please be aware that additional customs and tax fees may apply to your orders. These charges are beyond our control and are determined by your local customs office. Customs policies vary from country to country, so it is advisable to reach out to your local customs office in advance to understand the potential fees associated with your purchase.
